Are You Eligible for Social Security Disability Benefits?

To receive disability benefits under the Social Security Administration or Supplemental Security Income programs, you must have physical or mental health problems severe enough to keep you from working at a paying job for at least 12 months. The test isn’t whether you have been unable to get a job; the test is whether you are capable of doing jobs that exist in the work force in significant numbers.

The Social Security Administration uses an extensive set of regulations taking into account your medical condition, your age, education, training, and work experience in deciding if you qualify for disability payments.

About 60% of all applicants are initially denied benefits! But many of these people do ultimately receive benefits through a hearing. The hearing is informal and many may think they can easily represent themselves, but statistics have shown that people represented by an attorney have been successful more often than those without an attorney.

When should you contact an attorney? As with most things in life, the sooner the better. As your attorney we will do more than just sit at a hearing and ask questions. There is much pre-hearing preparation, analysis and evidence gathering. We will also work with your doctor explaining the social security regulations and obtaining a report. For these reasons, the earlier we start to work on your case the better your chances are of receiving benefits.

How much does it cost to hire an attorney? Attorneys charge clients in different ways, but all fees must be approved by the Social Security Administration. We do not charge you unless you receive benefits. To pay attorney fees, the Social Security Administration will usually withhold 25% of past due benefits. Nothing will be withheld from your regular monthly checks.

Call us today and we can sit and discuss your potential Social Security disability claim.
